We will now see if the Supreme Court has sold out to political doctrine, or if it will remain faithful to interpretating the Constitution without influence from any political party. Will the Court continue to separate Church and State or will it let the religious right have a guiding influence?

Excellent newsletter, Ari on an important women’s issue. First of all, I, as a woman, I don’t think that courts or any man (or a woman like Amy Coney Barrett) should make decisions about women’s bodies. It’s no surprise that all these challenges which went to the Supreme Court back then, came from the Southern (former Confederate) states as they always think that they are “holier than thou” in terms of the moral and religious beliefs/ arguments that they also bring up.

How come there are no laws on men’s bodies? As someone who is in the healthcare field (currently work in the pharmaceutical industry), I think that abortion is very risky but it is up to the woman to make that decision about her body, not the courts or men.

Well, we will see how the current Supreme Court justices go with keeping Roe vs. Wade or overturning it…this is when I wish that the late Justice Ruth Bader Ginsburg (Notorious RBG) was still around and I also wish that there are more women justices in the Supreme Court.

The evil tricks the Republicans have been playing for years are now coming to fruition. They have had a plan, and McConnell was the mastermind. Having Trump as president was the perfect outcome. They have no platform, only judges that will follow their plans. The three last appointees to the Supreme Court are doing exactly what they were brought in to do, along with the the other conservative judges. Our Constitutional rights are being stripped, layer by layer and it feels like some of the lawmakers in power are not doing anything to protect us. Excellent essay by Ari Melber and important positions in the comments!

We have to recognize that this is a very slippery slope, and any repeal of the right of reproductive choice in Roe will quickly lead states to ban all abortifacient medications and all medical devices that disrupt or prevent embryo implantation, like IUDs.

These six Supreme Court justices will be making a ruling based on their personal religious belief that "life begins at conception" which is a view NOT accepted by many religions.

There is absolutely no medical evidence in support of a decision to ban abortion after 50 years.

In a country founded by people who wanted to escape religious oppression, we are now a country controlled by the personal religious beliefs of six Supreme Court justices.

A bitter irony.

Following the repeal of Roe will come the prohibition of all contraceptive products, oral contraceptives, implanted birth control, diaphragms and condoms. Individuals who believe that life begins at conception also believe that the only acceptable birth control is the "rhythm method."

And since these six justices are making decisions solely based on their personal religious beliefs, next will come the repeal of the Court's same sex marriage decision, and finally, repeal of the Court's decision that consensual sexual relations between persons of the same sex cannot be made criminal conduct by state legislatures.

It almost doesn't matter at this point, as with the Court upholding of the anarchic Texas ruling, the "genie, has been let out of the bottle and allowed to escape". The court is trying to protect its image, more than it is trying to protect any notion of "settled law". Justice Sotomayor has it right on the money. The court will loose its favored status with the public, which will lead, after a long time to eventual Congressional rulings along the lines of imposing term limits on judges, or "stripping the court"of its judicial powers to rule in certain areas, or increasing the size of the court. In the meantime the majority will suffer this ruling. Until we get past this time of Tribal- minded justice, rather then government of the people, we are on a wayward and chaotic path with an uncertain future as a constitutional democracy. We as a governed nation seem to be more invested in compounding our differences than remembering, celebrating and enshrining what makes us unified and free. That's what it looks like from the bleachers, anyway.

I understand what you are saying, but I have less concern over abortion being banned after 15 weeks( almost 4 months) than a ban after 6 weeks with no exceptions which really provides no freedom of choice. Pro choice does not mean pro abortion. Maybe a miracle in judgement and interpretation will prevail if the Justices can leave their personal biases behind. Happy and safe holidays everyone, celebrate in the moment.

As a neighbor and former resident in America, I'm deeply, profoundly concerned with the current direction of the country. As a student of history, parallels cannot be denied. A few juxtaposed excerpts from "The Rise and Fall of the Third Reich," Chapter 8, "Life in the Third Reich: 1933-37," first sentence: "It was at this time in the late summer of 1934, that I came to live and work in the Third Reich." Author William L. Shirer was a journalist.

Using asterisks to denote substitution:

*Republicans* "were liquidating the past, with all its frustrations and disappointments. Step by step, and rapidly," *Trump* "was freeing" *America* from the shackles of *liberalism, ethnic and racial dilution* "and making *America* militarily strong again. And yet underneath the surface, hidden from the tourists during those splendid late-summer Olympic days in Berlin and indeed overlooked by most Grmans or accepted by them with a startling passivity, there seemed to be - to a foreigner at least - a degrading transformation of *American* life."

Rowe is in danger by a packed supreme court, one which signals intent to chip away abortion rights in addition to civil rights. Nineteen Republican-controlled state legislatures have enacted new restrictive voting rights, supervision, post-vote procedures and party-subordinate reporting officers. Illegal immigration at the southern border continues with little to no insight into incerception policies and procedures. Loose federalism, disdained by Republicans except in times of dire climate emergency, is more frequently and strongly challenged now, upheld or unruled upon by the supreme court.

I've probably said too much, but I say it from care as a neighbour and friend. News is fragmented, the industry struggles to survive, has become ideologically polarized, and the wider picture of the general direction of America is often not clear or obvious to citizens nation-wide. And we're living a never-ending pandemic and all it inflicts. Changing the extreme-rightward direction of America will be difficult and fraught. It's already deeply embedded. There are no easy of simple answers, only that the current trajectory must be opposed and challenged. Ari's mention of Justice Coney Barrett's response to the Rowe burden element was/is jolting, telling and disturbing: simply surrender the newborn infant - no need for the "burden" to continue and be considered in the ruling. Her callous response harkens back to another era, another terrible regime.

Honestly I see this Court and it’s inclinations as an assault on women’s rights. Fitting end to this annus horribilis. Maybe women who compose 51% of the Earth will rise up. Something to hope for. Afterall women’s rights are human rights.

This is how I feel. I don't think the government or anyone else has the right to tell a women what she has to do with her body. Anymore than telling her she can't have children or how many or only male or female children. They need to worry about more important issues. But that's just me. As far as rape they should not only allow a abortion, but perhaps they should castrate the rapist.

Ari, I’m just at the point of total disgust, primarily just tired of weak Democrats. We can’t fight, don’t know how to negotiate, how to work as a unit—we just don’t get it! This court is political, a bunch of liars, and at this point, working only for corporate America and other entities. Little to nothing for the people (I do recall Robert’s ACA vote. That was about him, not us).

While I’m ranting, Dems got all exercised, because Manchin said he would not vote for THIS legislation. The media carried it as, “not vote for Build Back Better.” We need to LISTEN! President Obama used to say, ‘Get what you can now and when the opportunity presents, try for the rest.’ Why can’t we get what Manchin is offering, then let Biden do what he can via Executive Order? Since they have cut things down to one, two or three years anyway, an Executive Order is all we need. We must leave some of these egos at home, for as I have come to realize, Manchin loves the limelight and like it or not, we have to go through him. Without his vote on Voting Rights, we can’t change THIS Supreme Court, for sure.

Ari, happy holidays to you and your family. This year is ending on a happy note with your successful News Letters and your show, "The Beat". The Supreme Court is deciding whether to end Roe v. Wade. Roe v Wade has been the law of the law for fifty years concerning a pregnant woman's liberty to choose to have an abortion without excessive government restriction. Abortion will remain a national issue no matter what the Supreme Court does. Abortion is an essential component of a women's health care. There is a lot to consider here between a woman and abortion. 1. Is the woman mentally fit or a danger to self . 2. A woman who becomes pregnant after a rape may face a decision about whether to terminate the the pregnancy. There is injury to consider, sexually transmitted infection and so forth. 3. Health issues, life death situation. So I feel that the decision should be with the woman, spouse, her physician, family to make the decision. Please do not leave out prayer.
